惩罚性赔偿制度是为了惩罚和遏制被告的违法行为,而判给原告超过其所受损害的金钱赔偿责任制度。一般来讲,大陆法系和英美法系国家对待惩罚性赔偿的态度有着较大区别,大陆法系国家在民事程序中不承认惩罚性赔偿,相对于大陆法系国家,普通法系国家似乎更愿意使用或者接受惩罚性赔偿。但最近几年,不管是哪个法系的国家,包括中国大陆及台湾地区在内,似乎有认可惩罚性赔偿的趋势,这主要表现在各国的立法和对外国惩罚性赔偿判决的态度上。

Punitive damage system is to punish and deter defendant’s wrong-doing and to award plaintiff the compensation which exceeds the actual damages. Generally speaking, the attitudes of civil law countries and common law countries to punitive damage are different. Civil law countries do not admit punitive damage in civil procedure while common law countries are willing to use or enforce punitive damage awards. But in recent years, all the countries and regions, including China and Taiwan, have had the tendency to admit punitive damage which is mainly manifested in legislation and the attitudes to punitive damage awards of other countries.
